So, what did owner do that was wrong? He has a mine and was mining it wasn't he? Is it government of the government for the government and NOT for the people anymore? Why does an owner need a permit to do anything on his/her own property? THAT is an issue. Now, if his/her work effects others then they may have an issue. However, there are to many laws that allow one voice to stop someone from using his/her own property because something "May" happen.
A miner should be allowed to mine his/her property. If you own mineral rights you should be allowed access to those minerals. If government takes that access away THEY are suspose to pay fair compensation. I don't see that brought up anywhere.
What dirty pollution got into the creek? Rocks and gravel? (I'm just guessing.) So, is rock and gravel now considered pollution when it falls into more rock and gravel?
Something seems rotten here and to me it's not mining your own gold mine. In my opinion. If you own property and pay taxes on this property the government is suspose to do all in it's power to protect that property and the right of the owner. Am I wrong here?
